Those who lost their Italian citizenship for having naturalized in a foreign country before 08/16/1992 may re-acquire Italian citizenship by using one of these two possible paths, which differ only by the time required for the re-acquisition
1. First hypothesis: the applicant makes a special declaration at the Consulate and establishes residency in Italy within 12 months from the date thereof.
2. Second hypothesis: the applicant sets up residence in Italy at a City without making any statement and waits 365 days.
In the first case, the foreign citizen can get back his/her citizenship after a few weeks, while in the second case at least a year is necessary, depending on the workload of the Italian municipality.
In both the Italian municipality of residence will be the entity to finalize the process of acquisition of Italian citizenship . The instructions below refer to the first hypothesis, since there is no provision in the second procedure.
BEFORE YOU LEAVE
A condition for such re-acquisition is the successful transmission by the Consulate of the foreign naturalization certificate of the applicant or the registration of the loss of citizenship by the municipality.
It is therefore necessary to check with the consulate (also via email) that the italian City is able to do so.
Applicant’s Statement: In order to proceed with the re-acquisition of citizenship in Italy, the applicant must sign a declaration of intent, which can be made to the City or Consulate, in the presence of two witnesses who are not members of the household, who are able to understand the Italian language and that present a form of identification.
Payment: For the re-acquisition it is necessary a 200 Euro fee, which must be paid before signing the declaration referred to above, at any bank, using the bank details indicated by the consulate. It is necessary to submit a photocopy of the the bank transfer receipt.
PROCESS IN ITALY
Within 8 days from arrival, you must apply for residence permit for re-acquisition of citizenship authorizing the applicant to stay for a year (the permit is renewable). This request is made through the Italian Post Office and the applicant will need to visit the post office and get the necessary forms that are used to apply for a residence permit and send them by mail with the other required documents.
- With the mailing receipt the applicant should then visit the town hall with his/her passport and request to be registered at the Registry of the resident population, and enrolled in the Health Service national, and submit the declaration made at Consulate, or alternatively declare that he/she wants to sign the declaration on there-acquisition of citizenship pursuant to art. 13 paragraph C of the Law 91/1992.
- It is likely the applicant will be requested to produce any documents required to be registered (i.e. documentation showing that he/she actually resides at that address indicated, the letter of invitation of relatives, or similar).
